Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and [Your LLC Name] ("we", "us", or "our") and govern your access to and use of the website at aigirlfriend.com and all related services (collectively, the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), to use the Service. By using the Service you represent and warrant that:

  • You are at least 18 (or 21 where applicable);
  • You are accessing the Service from a jurisdiction where adult content is legal;
  • You will not allow any minor to access the Service through your account or device;
  • You will complete any age verification process we require.

2. Nature of the Service

The Service provides interactive AI companions ("Companions") generated using artificial intelligence. All Companions are fictional characters generated by AI. No Companion depicts, is named after, or is intended to resemble any real person. All Companions are 25 years of age or older in their depicted lore. Any text, voice, or image produced by the Service is AI-generated.

3. Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions and Billing

Certain features require a paid subscription. By subscribing, you authorize us and our payment processor to charge the recurring fee disclosed at sign-up to your payment method until you cancel. Subscriptions automatically renew at the end of each billing period unless cancelled before renewal. All sales are final except as expressly stated in these Terms or as required by law.

5. Acceptable Use

You agree NOT to:

  • Use the Service to solicit, generate, or share content depicting minors in any sexual or sexually suggestive context;
  • Generate or attempt to generate content depicting non-consensual acts;
  • Generate or attempt to generate content depicting identifiable real persons without their consent;
  • Use the Service to defame, harass, threaten, or stalk any person;
  • Attempt to reverse-engineer, scrape, or otherwise extract the underlying models, prompts, or training data;
  • Use bots, scripts, or other automated means to access the Service;
  • Resell, sublicense, or commercially exploit any output of the Service except as expressly permitted;
  • Bypass any technical or content-policy safeguards;
  • Use the Service in violation of any applicable law.

We may, in our sole discretion, suspend or terminate your account for any violation. We reserve the right to report suspected violations involving the safety of minors to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement.

6. Intellectual Property

The Service, including all software, text, branding, Companion personalities, and visual designs, is owned by [Your LLC Name] or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial use, subject to these Terms.

7. User Content

Anything you submit to the Service (e.g. messages you send to Companions) is "User Content". You retain whatever rights you may have in your User Content. By submitting User Content, you grant us a worldwide, royalty-free, sublicensable license to use, store, and process it solely to operate, improve, and provide the Service.

8. AI-Generated Output

Output from the Service is generated by machine learning models. We do not guarantee its accuracy, originality, or fitness for any purpose. To the extent any rights subsist in AI-generated output produced for you, we grant you a personal, non-commercial license to use that output. You are responsible for how you use any output.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [Your LLC Name] SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) US$100.

11. Indemnification

You agree to defend, indemnify, and hold harmless [Your LLC Name] from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including any breach of these Terms. Upon termination, all rights granted to you under these Terms cease immediately.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of [Delaware/Wyoming/etc.], without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
